LHC announces big decision in favor of the mourners of Imam Hussain (AS)
Shiite News: The Lahore High Court (LHC) has given a big decision in favor of the mourners of Imam Hussain (a.s.).
LHC declared it an unconstitutional measure to not allow women’s Ashra Majlis by Police and Deputy Commissioner Hafizabad.
Article 20 of the Constitution provides religious freedom. Petitioner female founder of Majalis e Aza, Syeda Kaneez Hasan got court permission to conduct Majlis Aza.
According to the details, the petitioner Syeda Kaneez Hasan organized majlis Aza during Muharram last, when police registered a case against the applicant for organizing the Majlis without permission.
In this year 2023, the petitioner again applied to the concerned Deputy Commissioner for Majlis and Ashra, which the Deputy Commissioner rejected and refused to grant permission.
The petitioner challenged the Deputy Commissioner’s order in the Lahore High Court.
On which Justice Shams Mahmood Mirza asked the Government Attorney under which law you are not allowing this Ashra-e-Majalis.
To which the government lawyer replied that a case was registered against this woman last year also because of conducting a majlis.
Second, the Home Department has made a policy that no new Majlis can be held for which there is no history in the past.
On which the judge gave the verdict and said that Article 20 of the Constitution gives all citizens the fundamental right to promote, preach and publish their religion.
Any policy made by the Home Department which is against the fundamental rights of the citizens can never be accepted, besides the order issued by the Deputy Commissioner does not mention any such policy nor a reasonable cause has been stated for denying the applicant.
Therefore, keeping in view all the circumstances, the position of the petitioner was accepted and he was allowed to conduct the Ashra e Muharram without any license or permission.
It is hoped that after this clear and unequivocal decision of the Lahore High Court, in the future, no state institution or personality will use any tactic to stop the Majalis of the great-grandson of the Prophet, Imam Hussain (AS) in any corner of the country.
