Conflicting legislation declares evildoers of Umayyad, abbasid as companions of Prophet
Shiite News: PDM has dropped another bomb on the Shiite, and approved conflicting legislation – Toheen-e-Sahaba Bill a Criminal Amendment Bill 2021 is a nefarious attempt to directly target the Shia school of thought.
The conspiracy to include the evildoers and the enemies of the Ahl al-Bayt (A.S) of the Prophet (PBUH), the Umayyads and Abbasids in the list of Companions of Prophet (PBUH) and make them respectable succeeded.
It should be noted that the meeting of the National Assembly was held under the chairmanship of Speaker National Assembly Raja Pervez Ashraf.
During the meeting, Jamaat-e-Islami member of the National Assembly Maulana Abdul Akbar Chitrali presented the Bill which was unanimously approved by the members.
The minimum punishment for blasphemy will be 10 years and the maximum will be life imprisonment, whereas in the old law this punishment was up to 3 years.
This law was under process from 2019, approved by the National Assembly Committee on Home Affairs in July 2021 and has now been passed by the National Assembly. It still has to go to the Senate and the President before becoming law.
This law is a double-edged sword. On the one hand, its opposition will be interpreted as the opposition of the Companions of Prophet, etc.
On the other hand, the silence on this law and its approval in this condition will affect the citizens of the Shia school of thought mostly.
This law needs a discussion only between concerned institutions and individuals on technical grounds. For example, the definition of Sahabi in this law is vague, it needs to be clarified.
In Hanafi jurisprudence, the term of repentance has been accepted even for blasphemy of the Companions, even for Toheen-e-Risalat (blasphemy), while Pakistani law does not include repentance and remorse in these crimes.
Also, the difference between insult and criticism needs to be defined in the law, otherwise if this law is passed in this form, then every concept of Shia will gradually become a crime in this country.
Further, there is a need to educate our community about these laws in particular and about every law in general so that these laws can also be used for self-defense because these laws have this capacity.
Namoos-e-Sahaba Bill ambiguities:
1: What is the definition of Companions in the light of Quran and Sunnah?
2: The path of regret and repentance for every crime and mistake has been given by the religion of Islam. There is no explanation in this bill?
3. In this bill, it is also not clear which thing falls under the category of blasphemy. Is criticizing the character of the Companions in the light of history also an insult or abuse and slander?
4. It is quite clear in constitution that no law will be made against the teachings of Quran and Sunnah. So, has this law been discussed in the Islamic Ideological Council or any Shiite scholar.
5: This bill can be used by extremist and terrorist groups for their revenge. In this regard, there should also be a provision that no one should use it for their personal benefit.
Note: It is quite clear from the nature of the law that this was made only to counter the Shiite. Unfortunately, many Shiite legislators have also signed it.
