Religious Status of Nikah e Muta and its historical references

Shiitenews: On 13th Ramadan ul Mubarak at a TV channel BOL at question was asked from Allama Amin Shaheede about nikah e mutta he was not supposed to give answers due to making noise of his opponents. We request BOL TV to not debates on such topic. I am Zakir Asadi and I condemned this program my today’s article is about “what is religious status of Nikah e Muta?” Inshallah in this article references will be given from Quran, and Riwayat especially from the books of Ahl e Sunnat.

First of all Allah says in Surah Nisa verse number 24

ہیںوَّ الۡمُحۡصَنٰتُ مِنَ النِّسَآءِ اِلَّا مَا مَلَکَتۡ اَیۡمَانُکُمۡ ۚ کِتٰبَ اللّٰہِ عَلَیۡکُمۡ ۚ وَ اُحِلَّ لَکُمۡ مَّا وَرَآءَ ذٰلِکُمۡ اَنۡ تَبۡتَغُوۡا بِاَمۡوَالِکُمۡ مُّحۡصِنِیۡنَ غَیۡرَ مُسٰفِحِیۡنَ ؕ فَمَا اسۡتَمۡتَعۡتُمۡ بِہٖ مِنۡہُنَّ فَاٰتُوۡہُنَّ اُجُوۡرَہُنَّ فَرِیۡضَۃً ؕ وَ لَا جُنَاحَ عَلَیۡکُمۡ فِیۡمَا تَرٰضَیۡتُمۡ بِہٖ مِنۡۢ
بَعۡدِ الۡفَرِیۡضَۃِ ؕ اِنَّ اللّٰہَ کَانَ عَلِیۡمًا حَکِیۡمًا ﴿۲۴﴾ ”

Also (forbidden are) women already married, except those (captives and slaves) whom your right hands possess. Thus has Allah ordained for you. All others are lawful, provided you seek (them in marriage) with Mahr (bridal money given by the husband to his wife at the time of marriage) from your property, desiring chastity, not committing illegal sexual intercourse, so with those of whom you have enjoyed sexual relations, give them their Mahr as prescribed; but if after a Mahr is prescribed, you agree mutually (to give more), there is no sin on you. Surely, Allah is Ever All-Knowing, All-Wise.

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، حَدَّثَنَا جَرِيرٌ ، عَنْ إِسْمَاعِيلَ ، عَنْ قَيْسٍ ، قَالَ : قَالَ عَبْدُ اللَّهِ : كُنَّا نَغْزُو مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَيْسَ لَنَا شَيْءٌ ، فَقُلْنَا : أَلَا نَسْتَخْصِي ؟ فَنَهَانَا عَنْ ذَلِكَ ، ثُمَّ رَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ بِالثَّوْبِ ، ثُمَّ قَرَأَ عَلَيْنَا : يَأَيُّهَا الَّذِينَ آمَنُوا لا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللَّهُ لَكُمْ وَلا تَعْتَدُوا إِنَّ اللَّهَ لا يُحِبُّ الْمُعْتَدِينَ سورة المائدة آية 87

And it’s narrated from qais from Abdullah that he said that : ” whenever we went with holy Prophet S.A.W.W in jihad. We do not have any thing to get married so we asked him for castration of ourselves. He doesn’t allows us. And allow us to marry a woman ‌in return of a cloth. Than Holy Prophet S.A.W.W read the verse of Holy Quran for us, “O you who belive! Do not forbid yourselves good and pure things which Allah has made lawful for you, and do not transgrass. Verily Allah do not like the transgressors. (Bukhari, Hadith # 5075)

At another place

حَدَّثَنَا إِسْحَاقُ بْنُ جِبْرَائِيلَ الْبَغْدَادِيُّ، ‏‏‏‏‏‏أَخْبَرَنَا يَزِيدُ، ‏‏‏‏‏‏أَخْبَرَنَا مُوسَى بْنُ مُسْلِمِ بْنِ رُومَانَ، ‏‏‏‏‏‏عَنْ أَبِي الزُّبَيْرِ، ‏‏‏‏‏‏عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، ‏‏‏‏‏‏أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنْ أَعْطَى فِي صَدَاقِ امْرَأَةٍ مِلْءَ كَفَّيْهِ سَوِيقًا أَوْ تَمْرًا فَقَدِ اسْتَحَلَّ . قَالَ أَبُو دَاوُد:‏‏‏‏ رَوَاهُ عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، ‏‏‏‏‏‏عَنْ صَالِحِ بْنِ رُومَانَ، ‏‏‏‏‏‏عَنْ أَبِي الزُّبَيْرِ، ‏‏‏‏‏‏عَنْ جَابِرٍ مَوْقُوفًا. وَرَوَاهُأَبُو عَاصِمٍ، ‏‏‏‏‏‏عَنْ صَالِحِ بْنِ رُومَانَ، ‏‏‏‏‏‏عَنْ أَبِي الزُّبَيْرِ، ‏‏‏‏‏‏عَنْ جَابِرٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ كُنَّا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَسْتَمْتِعُ بِالْقُبْضَةِ مِنَ الطَّعَامِ عَلَى مَعْنَى الْمُتْعَةِ. قَالَ أَبُو دَاوُد:‏‏‏‏ رَوَاهُ ابْنُ جُرَيْجٍ، ‏‏‏‏‏‏عَنْ أَبِي الزُّبَيْرِ، ‏‏‏‏‏‏عَنْ جَابِرٍ، ‏‏‏‏‏‏عَلَى مَعْنَى أَبِي عَاصِمٍ

it’s is narrated that once Holy Prophet S.A.W.W said that “if some give a finch of dates or Satu(kind of wheat) to a woman that he makes that woman lawful for him. And Abdul Rahman Bin Mehdi Said that he is narrating from Saleh Bin Ruman who is narrating from Abu Zubair and so Jabir R.A that Jabir said that in age of Holy Prophet S.A.W.W we make Nikah e Muta by one finch of grain.
Abu Davud said that he has narrated the same story from Abu Zubair ,that Asik has narrated this from Jabir. (Sunan Abu Davud, Haworth # 2110)

حَدَّثَنَا عَلِيٌّ ، حَدَّثَنَا سُفْيَانُ ، قَالَ عَمْرٌو ، عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ وَسَلَمَةَ بْنِ الْأَكْوَعِ ، قَالَا : كُنَّا فِي جَيْشٍ فَأَتَانَا رَسُولُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنَّهُ قَدْ أُذِنَ لَكُمْ أَنْ تَسْتَمْتِعُوا فَاسْتَمْتِعُوا

We were in an army than Holy Prophet S.A.W.W came to us and said that you are allowed to make nikkah e Muta therefore you can do it.( Bukhari # 5117)

And also narrated that:

وحَدَّثَنَا الْحَسَنُ الْحُلْوَانِيُّ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، قَالَ: قَالَ عَطَاءٌ: قَدِمَ جَابِرُ بْنُ عَبْدِ اللهِ مُعْتَمِرًا، فَجِئْنَاهُ فِي مَنْزِلِهِ، فَسَأَلَهُ الْقَوْمُ عَنْ أَشْيَاءَ، ثُمَّ ذَكَرُوا الْمُتْعَةَ، فَقَالَ: «نَعَمْ، اسْتَمْتَعْنَا عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَأَبِي بَكْرٍ، وَعُمَرَ

Ata says that when Hazrat Jabir Ibn Abdullah come to Makkah for umrah we went to met him at his place where we asked him alot of things from him and when there was a talk of Nikah e Muta he says that .. ” yes we had made Nikah e Muta in the age of Holy Prophet S.A.W.W, Abu Bakr R.A and Umar R.A”. (Muslim # 3415)

And also

وحَدَّثَنِي أُمَيَّةُ بْنُ بِسْطَامَ الْعَيْشِيُّ، حَدَّثَنَا يَزِيدُ يَعْنِي ابْنَ زُرَيْعٍ، حَدَّثَنَا رَوْحٌ يَعْنِي ابْنَ الْقَاسِمِ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ، عَنْ سَلَمَةَ بْنِ الْأَكْوَعِ، وَجَابِرِ بْنِ عَبْدِ اللهِ، «أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَتَانَا فَأَذِنَ لَنَا فِي الْمُتْعَةِ»

once Rooh Ibn e Qasim narrated a hadith for us from Amruu Ibn e Dinar he was narrating from Hassan Ibn e Muhammad he from Salma bint Aku and she from Jabir Ibn Abdullah R.A that Holy Prophet S.A.W.W came to us and in an announcement Nikah e Muta set allowed to us. (Mualim, hadn’t # 3414)

Another hadith

حَدَّثَنَا حَامِدُ بْنُ عُمَرَ الْبَكْرَاوِيُّ، حَدَّثَنَا عَبْدُ الْوَاحِدِ يَعْنِي ابْنَ زِيَادٍ، عَنْ عَاصِمٍ، عَنْ أَبِي نَضْرَةَ، قَالَ: كُنْتُ عِنْدَ جَابِرِ بْنِ عَبْدِ اللهِ، فَأَتَاهُ آتٍ، فَقَالَ: ابْنُ عَبَّاسٍ وَابْنُ الزُّبَيْرِ اخْتَلَفَا فِي الْمُتْعَتَيْنِ، فَقَالَ جَابِرٌ: «فَعَلْنَاهُمَا مَعَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ نَهَانَا عَنْهُمَا عُمَرُ،

Abu Nuzairah said that once I was sitting beside Jabir ibn Abdullah a person came saying this that Ibn e Abbas and ibn e Zubair both has different views on both “Mutaas” ( haj e tamatu and Nikah e Muta) than Jabir replied that, ” we had performed both jobs in age of Holy Prophet S.A.W.W but then Umar forbidden these.” (Muslim hadith # 3417).
